Build-A-Bear Workshop® Huggable Heroes® Contest OFFICIAL RULES THERE IS NO PURCHASE NECESSARY TO ENTER OR TO WIN. ENTRY TO THE CONTEST IS FREE. Open to legal residents of the 50 United States, District of Columbia, Puerto Rico and Canada who are 8 years of age or older. Void Where Prohibited.
CONTEST DESCRIPTION: If you know an individual, including yourself, who is between the ages of 8 - 18 years old as of February 26, 2010, who should be recognized for the significant difference they have made/make to the quality of life in their community, we invite you to enter him/her for the title of “Huggable Hero®”. § Nominator: A Nominator is someone 8 years of age or older who wishes to submit an entry on behalf of someone (which can include themselves if they meet the Nominee criteria) into the Huggable Heroes Contest. § Nominee: A Nominee is someone between the ages of 8 – 18 as of February 26, 2010 who is doing things to make a difference in their community. NO PURCHASE NECESSARY. Purchase will NOT increase your chances of winning. Entry to the Contest is free. Contest is subject to all applicable federal, state, provincial and local laws & regulations. U.S. and Canadian law governs this Contest. VOID WHERE PROHIBITED.
START AND END DATES: The Contest begins 10:00:01 a.m. Eastern Time (“ET”) on January 15, 2010 and ends 5:00:00 p.m. ET on February 26, 2010 (“Entry Period”). Online entries must be submitted by 5:00:00 p.m. ET on February 26, 2010 and mail-in Entries must be postmarked by February 26, 2010 and received by March 5, 2010. Entries postmarked or received after these dates will not be accepted.
ELIGIBILITY: § Nominator and Nominee must both be a legal resident of the 50 United States, District of Columbia, Puerto Rico (collectively the “U.S.”), or Canada (including Quebec). Nominator must be 8 years of age or older and Nominee must be between the ages of 8 and 18 years of age as of February 26, 2010. § Individuals employed by or otherwise associated with Build-A-Bear Workshop, Inc., or the judging organization, their promotional partners, agencies, affiliates, members of their immediate families (“Releasees”), persons living in the same household of these individuals are not eligible to enter someone, be entered or win a Prize. § Any individual named a Build-A-Bear Workshop® Huggable Hero in any past contest is not eligible to be entered or win a Prize, but is eligible to enter someone else. By entering Nominators and Nominees agree to comply with these Official Rules (and the Abbreviated Official Rules which form part of these Official Rules) and any modified version of the same. Sponsor reserves the right in its sole discretion to disqualify any entry at any time which, in Sponsor’s opinion, does not comply with these Official Rules.
TERMS OF NOMINATION: § A Nominator may enter themselves. § A Nominator may enter more than one Nominee so long as each entry is a separate Entry, meets all entry requirements, and if submitted by mail, sent in a separate outside envelope. § A Nominee may be entered multiple times so long as each entry is from a different Nominator, is an original Entry, meets all other entry requirements and is submitted in a separate outside envelope. § Multiple entries that do not comply with the Official Rules may be disqualified.
HOW TO ENTER: There are two (2) ways to enter.
TO ENTER ONLINE: U.S. residents log on to www.buildabear.com/huggableheroes and Canadian residents log on to www.buildabear.ca/huggableheroes and follow the links to the Contest area. § STEP ONE: You will first be asked your date of birth, the age of the person you are nominating and the state(s)/province(s) that you and your nominee live in. § STEP TWO – Provide Nominator Information: o If you are between 8 and 12 years of age you will be asked to enter your first name, your parent or legal guardian’s e-mail address and check the correct box to denote if this entry is about you or another person. You will also be asked to complete the answers to the community service questions as outlined below. If you are entering yourself no other information will be required of you. o If you are 13 years of age or older you will be asked to provide your full name, address, city, ZIP/Postal Code, phone number and email address and check the correct box to denote if this entry is about you or another person. You will also be asked to complete the answers to the community service questions as outlined below. If you are entering yourself no other information will be required of you. o If you are a Nominator of age 19 or older you will also be asked if you are the parent or legal guardian of the person you are entering. § STEP THREE – Provide Nominee Information (if you are not nominating yourself): o If your Nominee is between the ages of 8 and 12 and not your child: you will be asked for their first name and their parent or legal guardian’s email address. No other information about the person you are nominating will be collected from you. o If your Nominee is your child OR is between the ages of 13 and 18 you will be asked for their full name, address, city, state/province, ZIP/Postal Code, email address and phone number. § STEP FOUR: All Nominators regardless of age will be required to answer the short questions about their Nominee’s community service project describing how their Nominee demonstrated extraordinary service in time, effort and results for their cause that made a difference to the quality of life in their community and/or around the world. § STEP FIVE: Once you have completed your Entry click the “Submit” button to enter.
PARENT/LEGAL GUARDIAN PERMISSION FOR NOMINATORS AND/OR NOMINEES AGES 8 TO 12: § For Nominators and/or Nominees ages 8 to 12 who are not entered by a parent or legal guardian, a first email notice will be sent to the parent/legal guardian email address provided by the Nominator. § FIRST EMAIL NOTICE: Parent/legal guardian of a Nominator and/or Nominee will be given the opportunity to consent or decline their child’s participation into the Contest. Parent/legal guardian of a Nominator and/or Nominee will be given the opportunity to review the information submitted by the entrant and provide consent to your child’s participation in the Contest as either a Nominator, Nominee, or both by going to the online form via link provided in the email sent to you. You can then read the answers to the short questions regarding the Nominee’s community service project submitted and provide consent by providing the full name of parent/legal guardian, child’s full name, address, city, state/province, ZIP/Postal Code, telephone number, parental permission to participate in this Contest and child’s date of birth. § Without regard to Nominator/Nominee status, for any entry involving an 8 – 12 year old, the contest entry will not be considered complete until a parent/legal guardian has completed the verification process. § SECOND EMAIL NOTICE: Once the parent/legal guardian completes and submits the online form the parent/legal guardian will receive a second confirmation email confirming their child’s Nominator/Nominee status. Parent/legal guardian of the Nominator/Nominee will be given the opportunity a second time to prohibit the Nominator/Nominee from entering the Contest by having the Nominator/Nominee’s registration and personal information removed from the site. § A parent/legal guardian can prohibit their child from entering the Contest as a Nominator/Nominee in response to any of the above two email notices or at any time during Promotion Period by clicking on the link provided in one of the two parent/legal guardian emails they receive. § Parent/legal guardian of a Nominator/Nominee who have questions or concerns regarding Sponsor’s use of an entrant’s personal information can review Sponsor’s Privacy Policy at www.buildabear.com/AboutUs/OurCompany/Privacy.aspx (for U.S residents), or www.buildabear.ca/AboutUs/OurCompany/Privacy.aspx (for Canadian residents).
TO ENTER BY MAIL: Official Entry Forms are available in-store at participating Build-A-Bear Workshop® locations in the United States, District of Columbia, Puerto Rico and Canada while supplies last and online at www.buildabear.com/huggableheroes (U.S. residents) or www.buildabear.ca/huggableheroes (Canadian residents). § The following stores are not participating in the promotion so you will not be able to find entry forms at these locations: Build-A-Dino™ by Build-A-Bear Workshop®, operated by and located within T-Rex Café located in the Legends of West Village, Kansas City, KS; Build-A-Bear Workshop® At Rainforest Cafe®; and Build-A-Bear Workshop® On Tour. § To print an Entry Form online, log onto one of the website addresses listed above, select the “mail-in option” and download the printable Entry Form. § Complete all requested information including providing parental consent signature, place in a stamped envelope and mail along with your short answer responses to the community service questions (hand printed or typed on a separate sheet of paper if needed) to “Huggable Heroes Contest Entry” to one of the following addresses: United States/District of Columbia/Puerto Rico residents: P.O. Box 4319, Manhasset, NY 11030-4319. Canadian residents: P.O. Box 10001, 5576 Yonge Street, North York, Ontario, M2N OB6, Canada. § Mechanically reproduced, illegible, incomplete or inaccurate entries are void. Sponsor assumes no responsibility for late, incomplete, lost, postage-due, misdirected or undeliverable mail.
IMPORTANT INFORMATION ABOUT YOUR ENTRY: § “Entry” is defined, for purposes of this contest, as including both the Entry Form and the short answer questions about the Nominee’s community service project submitted with it. Any additional materials submitted with Entry (i.e., photos, newspaper clippings, etc) will not be judged and will not be acknowledged or returned. § Each Entry submitted on an Official Entry Form or online must be COMPLETELY filled out including the short answer questions in the Entry Form regarding the nominee’s community service. § Answers to each of the short answer questions cannot exceed the maximum word count indicated below. § For mail-in entries, the signature is required of the parent/legal guardian of Nominee and where applicable of a Nominator who is a minor in their state or province of residence evidencing their permission to participate in this Contest and to provide this information. § Entries can be submitted in English, French or Spanish. § Entries received that are illegible, incomplete, or are not submitted on an official Entry form or online will be disqualified. § Nominator certifies that the submission is his/her original work and that he/she has all rights to the submission; that it has not been previously entered into another contest, published, released, or distributed; does not infringe on any third party rights; and is suitable for the Contest. § Nominators irrevocably assign to Sponsor with full title guarantee all intellectual property and other rights, which they now have or may in the future have to the Entries, or any elements thereof, including without limitation, the copyright therein, the right to make derivative works, copies and to use for any purpose whatsoever all media, royalty-free worldwide perpetuity. Sponsor shall have the right to assign or dispose of such Entries however it sees fit without approval of the Nominator or Nominee. § Sponsor is under no obligation to correspond about Entries and Entries will not be acknowledged or returned.
PLEASE TELL US ABOUT THE NOMINEE’S CAUSE BY ANSWERING THE FOLLOWING: 1 – Describe the Community Service Project (in 25 words or less) 2 – Tell us about what he/she did/does (in 100 words or less) 3 – Explain what inspired or motivated this individual to get involved in helping others (in 100 words or less) 4 – Give examples of the accomplishments and/or the impact/inspiration he/she is making/made (in 100 words or less) 5 – Tell us: a.) How many hours does your nominee volunteer a month? b.) How much money has your nominee raised for their cause and/or how many items have they collected or assembled for their cause? 6 – Is there anything else you would like us to know about this individual (in 100 words or less)
JUDGING: All eligible Entries received by the close of the Entry Period will be sorted based on the nominee’s address into one of two groups: U.S., D.C. or P.R. (collectively, “U.S.”) or Canada and Quebec (collectively, “Canada”). Marden-Kane, Inc., an independent judging organization, will oversee the judging. All eligible entries received will be scored based on the following judging criteria*:
· Accomplishments and impact of the accomplishments (75% of total score) · Inspiration to others relating to cause (25% of total score)
*In the event of a tie in any stage of judging, the Winner(s) will be determined based on whichever Entry received the highest score in the accomplishments and impact category from the judging criteria. In the event of a tie in both judging criteria, the Entries would be re-judged by a different panel of judges.
Seventy-Five (75) Semifinalists: The top-scoring sixty-five (65) entries from the U.S. and ten (10) entries from Canada will be deemed a Semifinalist. Twenty-five (25) Finalists: The Semifinalists will be re-judged based on the judging criteria to determine the twenty-five (25) Finalists (twenty (20) from the U.S. and five (5) from Canada). Ten (10) Huggable Heroes Grand Prize Winners (“Winners”): The twenty-five (25) Finalist entries will be re-judged based on the judging criteria by Build-A-Bear Workshop, Inc. to determine the ten (10) Huggable Heroes winners (eight (8) from the U.S. and two (2) from Canada).
Nominees identified as a Semifinalist, Finalist and/or Grand Prize Winner and his/her parent or legal guardian will be notified by mail. Non-winners will not be notified. Winners may be contacted by telephone and be required to complete a phone interview with a representative of Build-A-Bear Workshop®.
WINNER NOTIFICATION AND TIMEABLE:
PRIZES: § Ten (10) Huggable Heroes Grand Prizes: (8 from the U.S. and 2 from CAN): A $7,500 USD educational savings scholarship; a $2,500 USD donation toward Winner’s choice of a 501 (c)(3) designated charity or a registered Canadian Charity; a trip to a city in the U.S. chosen by Sponsor for Nominee and one Guest at a designated time in July 2010 (Approximate Retail Value (“ARV”) of trip: $2,000 USD); and a Flip Mino HD Video Camera (ARV of camera: $200 USD). U.S. charitable donation prize will be issued from Build-A-Bear Workshop Foundation. Trip portion of prize includes: Roundtrip standard class air transportation from major airport nearest to winner’s residence to designated city at a predetermined time; minimum of one (1) night double occupancy standard hotel accommodations, and ground transportation to/from airport/hotel at destination city only. The air transportation, ground transportation, and accommodations will be at the sole discretion of the Sponsor. Total ARV of prize: $12,200 USD each. § Twenty-five (25) Finalist Prizes: A $50 Build-A-Bear Workshop® Bear Buck$® gift card, ARV: $50 USD each. § Seventy-five (75) Semifinalist Prizes: A $15 Build-A-Bear Workshop® Bear Buck$® gift card, ARV: $15 USD each. Total ARV of all prizes: US $124,375. Prizes will be awarded to winning Nominees or parent/legal guardian on behalf of winning Nominee if a minor. For Canadian Winners: All above prize values are based on the US Dollar and Canadian exchange rates will be based on these above stated values. Finalists and Semifinalists prizes will be issued in the equivalent Canadian exchange rate of the US gift card value based on the exchange rate as of when the gift card is mailed to the winner in approximately April and May 2010. Educational saving scholarship and donation to the winner’s charity portion of the Grand prize will be issued in the equivalent Canadian exchange rate as of September 1, 2010 based on USD.
CONDITIONS OF PRIZE: Potential Semifinalist Winners and their parent/legal guardian will be required to complete and return within seven (7) days an Affidavit of Eligibility and release of liability/publicity, along with a recent photograph of the Semifinalist. Failure to do so may result in disqualification and an alternate Winner being determined. All cash portions of the prizes shall be awarded in winner’s local currency. Donation portion of prize will be awarded in the form of a check and must go to a 501(c)(3) designated charity or a registered Canadian charity. Winner must be accompanied by the parent/guardian that consented to the entry or another family member (over the age of majority in their state/province of residence) to which minor’s parent/guardian consents to in writing and both must travel together on the same itinerary and be able to travel on a date specified by Sponsor in July 2010, or Prize may be forfeited and the next highest-scoring nomination will be deemed the winner. Winner and accompanier are responsible for all costs and expenses not specifically mentioned above or in the Official Rules. Both must not have any medical, legal or any other reason that would prevent them from taking the prize and Winners and accompaniers from Puerto Rico or Canada must have valid documents for travel to and from the United States. The Prize will be forfeited if: The proper travel documents are not obtained by the Winner and accompanier by the date specified by Sponsor; or Winner and/or accompanier does not have the right, at the time of being chosen as a Winner or by the date the trip is booked, to re-enter home country of residence after leaving the United States; or if any immigration complications arise which prevent a Winner and/or accompanier from entering, leaving or traveling within the United States. Both are bound by the terms and conditions of all airlines, hotels and other third party service providers used in connection with the Prize. Prizes are not transferable and cannot be assigned, redeemed for cash, substituted (except by Sponsor, in its sole discretion) and will not be replaced if tickets, gift cards, etc are lost, stolen, or misplaced by Winner or if booked transportations are missed for any reason. If a Prize is unavailable, a Prize of equal or greater value will be awarded. If a Winner is under 18 (or a resident of P.R. 18 or under), Prize will be awarded to parent/legal guardian on behalf of winning Nominee as indicated on the Entry. All taxes on prizes won by a U.S. resident and other expenses related to accepting the prize are the sole responsibility of the Winner and parent or legal guardian of the Winner. U.S. resident Grand Prize Winners will receive a cash payment equal to 30% of the actual cost for the trip and camera portion of the Grand Prize to assist in payment of US taxes. Exact dates and locations are subject to change, and are at the sole discretion of Sponsor. Guest of Winner must complete a liability release before any travel documents are prepared or issued. Sponsor reserves the right in is sole discretion to re-judge some entries (per the criteria set forth in the official rules) and award additional portions of the grand prize.
GENERAL RULES: All Prizes will be awarded, provided more than enough qualified entries have been received in their respective country. Decisions of the Sponsor and judging organization are final and binding in all respects of the Contest and no correspondence shall be entered into. WAIVER, RELEASE AND LIMITATION OF LIABILITY: By entering, Nominators and Nominees hereby acknowledge that their entry in the Contest is voluntary and waive, release and agree to hold harmless the Sponsor, its subsidiaries, partners, agencies and employees of these companies (collectively, “The Releasees”) from and against any and all rights, demands, claims, causes of action whatsoever which Nominator and/or Nominee may now have, or which may inure to their benefit in the future, against any of the Releasees for any liability for any matter, cause or thing whatsoever--including but not limited to any damage, injury, loss whether direct, compensatory, incidental or consequential, to person (including death) and property--arising in whole or in part, directly or indirectly, from their acceptance of the Prize, their entry in the Contest or their participation in any prize related activity, or any travel related to the Prize or any prize related activity. By accepting a Prize, the Nominee grants permission for their description, likeness, statements, and biographical information (including name, city and state) to be used without limitation or further compensation, for advertising and publicity purposes, except where prohibited by law including but not limited to the creation of the Sponsor’s 2011 Build-A-Bear Workshop® Calendar and on website, www.buildabear.com or www.buildabear.ca.
INTERNET: Participants further agree that the Releasees are not responsible for the following: (a) Electronic transmissions, entries or submissions that are lost, late, stolen, incomplete, illegible, damaged, garbled, destroyed, misdirected or not received by Sponsor or its agents for any reason; (b) Any problems or technical malfunctions, errors, omissions, interruptions, deletions, defects, delays in operation or transmission, communication failures and/or human error that may occur in the transmission, receipt or processing of entries or related materials; or for destruction of or unauthorized access to, or alteration of, entries or related material; (c) Failed or unavailable hardware, network, software or telephone transmissions, damage to entrants’ or any person’s computer and/or its contents related to or resulting from participation in this Contest, or (d) Causes beyond Sponsor’s reasonable control that jeopardize the administration, security, fairness, integrity or proper conduct of this Contest; (e) Any entries submitted in a manner that is not expressly allowed under these rules (all such entries will be disqualified); (f) Any printing errors in these Official Rules or in any advertisements or correspondence in connection with this promotion. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Contest should virus, bugs, fraud, hacking or other causes beyond the control of the Sponsor corrupt the administration, security or proper play of the Contest. In such cases, notice to this effect will be posted on the website at www.buildabear.com or www.buildabear.ca and winners will be determined from all eligible entries received prior to cancellation.
CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO DISQUALIFY AND SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

Sponsor will use personal information collected from Nominator and Nominee for the purpose of administering the Contest only. Sponsor shall not sell, share or otherwise disclose personal information of Nominees and Nominators to/with third parties, other than to/with third parties engaged by Sponsor to fulfill the above purposes or as otherwise consented to by the Nominator or Nominee. ADDITIONAL RULES CANADIAN RESIDENTS OF QUEBEC: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Regie des alcools, des courses et des jeux for ruling. Any litigation respecting the awarding of a prize may be submitted to the Regie only for purpose of helping the parties reach a settlement.
WINNERS’ LIST: After August 3, 2010 winners will be posted online at www.buildabear.com/huggableheroes (for US residents) or www.buildabear.ca/huggableheroes (for Canadian residents), or, mail a self addressed stamped envelope for receipt by July 28, 2010, to Huggable Heroes Winners, Marden-Kane, Inc., 36 Maple Place, Manhasset, NY 11030. Residents of Vermont and Canada may omit return postage.
